TERMS AND CONDITIONS – WINE VOUCHER PROMOTION

Information on how to claim the wine voucher the subject of this promotion forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.  This offer is not valid in conjunction with any other offer, unless otherwise advised.

Who Can Enter

 

This promotion is only open to residents of Great Britain, the Channel Islands and the Isle of Man aged 18 years and over.  Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible for this promotion.  This promotion is not open to trade (commercial) or wholesale customers. This promotion applies to purchases of “A-grade” products only and does not apply to purchases of trade seconds or refurbished products.

 

Promotional Period

The promotion commences GMT 12th September 2018 at 00.01am and closes GMT 18th November 2018 at 11.59pm (Promotional Period). Claims must be received by the Promoter by 21st December 2018 at 11.59 (Claims End Date), any claims received after this date will be ineligible.

 

How to Claim

 

Purchase any qualifying Fisher & Paykel wine cabinet from the products set out below (Qualifying Products) from www.fisherpaykel.com/uk or a participating Fisher & Paykel retailer during the Promotional Period and you will be eligible to receive a wine voucher to the value of £100 (Voucher).

You must register for your claim online here www.fisherpaykelpromotions.co.uk

Registrations close on the Claims End Date after which no further claims will be accepted. Claimants must agree to these full Terms and Conditions on the online registration form and supply the information marked as mandatory, including providing proof of purchase (or proof of rental agreement).

When registering your claim you must supply the following information:

  1. Name and Contact details – name (which must match the name on the proof of purchase or online order confirmation email if purchasing online at www.fisherpaykel.com/uk), physical address (not a PO Box), email address and daytime contact phone number.    
  2. Valid serial number(s) of your Qualifying Product(s). These can be found either on the outer packing or on the product itself. If you have trouble finding the serial number, you can call Fisher & Paykel Customer Care on 08000 886 605.
  3. Copy of your proof of purchase
    1. If purchasing through a selected retailer - a receipt/tax invoice indicating date of purchase, store, invoice number, details of Qualifying Product(s) including model number, the customer name, the price paid and total invoice amount. If you purchase online, then an online order confirmation and delivery note will suffice, if they show details of the Qualifying Product(s), including model number and the date purchased.
    2. If purchasing directly at www.fisherpaykel.com/uk - your order confirmation email indicating date of purchase, online order number, details of Qualifying Product(s) including model number, the price paid (excluding any additional charges e.g. warranty costs) and total invoice amount.

You can supply your proof of purchase by either uploading, scanning or taking a photo of your proof of purchase and uploading it to your online registration form.

 

Claimants must retain the original proof of purchase.  Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in the invalidation of a claimant’s claim and forfeiture to any right to participate in this promotion. 

 

Purchases must be paid for in full and from the same participating retailer on the same day.  Lay-bys will not be eligible to participate in this promotion unless paid in full by the end of the Promotional Period. Qualifying Product(s) purchased under finance or payment agreements are eligible to participate in this promotion.

 

If a Qualifying Product is on backorder ('out of stock') the required deposit on that product must be paid during the Promotional Period to be eligible for this offer. Full payment and receipt of the Qualifying Product(s) (and therefore access to the product serial number) must occur before the Claims End Date (21st December 2018 at 11.59pm) in order to lodge a qualifying claim for this promotional offer.

 

If your claim is approved an approval email will be sent to you at the email address supplied in your claim. If you do not receive your Voucher within 30 days from receipt of your approval email, please contact the Promoter either by email at FisherPaykelPromotions@360incentives.com (remember to include your full name, contact number and unique code (from your approval email), or by calling 0800 048 8927.

 

The claimant is responsible for providing complete and correct contact details.

 

 

 

General

 

The Promoter (or its associated or affiliated companies or third parties who have licensed its brands to the Promoter or contributed to the application) (“Content Owner”) own or licence from third parties all application content. All application content remains the sole property of the applicable Content Owner and is protected under all relevant copyright, trade mark and other applicable laws. Nothing on the application should be construed as granting any licence or rights to use or distribute any application content, without the Promoter’s express written agreement or of the other applicable Content Owner.

This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to the Promoter and not to Facebook.  

The claimant agrees that if they have obtained the Voucher but then return any of the Qualifying Product(s) (under any returns policy the store may have) they will also return the Voucher to the Promoter.

 

If the Voucher or any part of the Voucher is unavailable, the Promoter, in its discretion, reserves the right to substitute the Voucher, or that part of the Voucher, with an item of equal or greater value.

 

Vouchers cannot be exchanged for cash.

 

The Promoter accepts no responsibility for lost, delayed, misdirected, incorrect or illegible claims. Incomplete, incorrect, illegible or indecipherable claim forms will be deemed invalid.


The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any person who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claims process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

The Promoter may, in its sole discretion, to the fullest extent permitted by law, disqualify any claimant or modify, suspend, terminate or cancel the promotion.  The decision of the Promoter is final and no correspondence will be entered into.

Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.

 

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) and Facebook exclude all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter); (d) any variation in Voucher value; (e) any tax liability incurred by a claimant; (f) use of a Voucher; or (g) participation in the promotion.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties including, but not limited to, suppliers, or use such information to contact the claimant in relation to this promotion.  Receipt of the Voucher is conditional on providing this information. In addition, if the claimant checks the relevant box in the claims form when registering a claim, the Promoter may use the claimant’s personal information for the purposes specified in the claims form at the time of collection.  Claimants should direct any request to access, update or correct information to the Promoter.

 

All claims become the property of the Promoter.

The Promoter may vary these Terms and Conditions at any time without notice.

 

These Terms and Conditions are governed by the laws of England and Wales.
